Municipal authorities in the theory and practice of the rule of people: problems OF relations and interactions

Abstract

The article deals with the constitutional and legal problems of the organization and functioning of municipal power in the context of its relation to the phenomenon of democracy. The evolution of the system of perceptions of local self-government in domestic and foreign legal thought in the aspect of theoretical and methodological understanding of the doctrine of municipal power is covered. This formulation of the question is conditioned by the fact that the questions concerning the place and role of municipal power in the system of democracy, its legal nature, the relation and interaction of such phenomena as democracy and public administration are among the most debatable in modern constitutional theory.

The purpose of the study is to deepen the conceptual and constitutional foundations of municipal power as a general legal category, a category of modern constitutional law and democracy, as well as a type of public power.

To obtain the most productive results and to make the most optimal conclusions about the problems of municipal power within the framework of the general theory of democracy, only by using a comprehensive conceptual-constitutional approach, considering, for example, the formation and development of local self-government and municipal power within the evolutionary process of development of nature and society. . With this methodological approach, municipal power must be seen as a political, legal, and socio-cultural phenomenon that emerges as a result of human evolution. From this point of view, the municipal power is no longer the result of an act of state redevelopment or the generation of the subjective will of the majority, but the manifestation of objective (natural) phenomena of socio-political development, which cannot be ignored.

It is concluded that public power is not the exclusive prerogative of the state, there are several types of it. The differentiation of public authority is due to its specific features, types and formal, subject-object and functional characteristics. Noting the multidimensionality and multidimensionality of the phenomenon of power, the author proceeds from the conceptual position according to which the source of power is the organization of a society for which it is an important function, which provides an orderly, regulative influence on all major spheres of public life.

It is argued that the modern doctrine of public authority should be based on the idea of forms, types and levels of public authority, including the existence of three forms of public authority (direct democracy, popular representation, non-representative forms of functioning of public power, or so-called professional rule), public authority (public authority of the Ukrainian people, state power and municipal government) and three levels of its implementation (national, regional and local).

The analysis of conceptual problems of the organization and functioning of public power in modern Ukraine, which are conditioned by the formation of a democratic social-legal state and civil society institutions, shows that the basis of these processes - recognition and guarantee of local self-government as an independent level of exercise by the Ukrainian people of the proper power and organizational and functionally separated from the state type of public power of the territorial community, which (power) should be considered as municipal power. In this context, the constitutional and legal nature of municipal power as a type of public authority in Ukraine is revealed.
