Concepts, values, separate categories of criminal processing activity of the victim in criminal proceedings

Abstract

The article explores the concepts, meanings, and individual categories of criminal proceedings of the victim in criminal proceedings. The importance of communicative barriers to the legitimate interests of the victim in criminal proceedings is emphasized.

It is emphasized that the lawfulness of criminal proceedings involves such a way of action of the subject in the protection of his rights and interests, which would meet the requirements of the sectoral legislation, even imperfect. After all, criminal proceedings are understood not only as criminal proceedings (inactivity) of the victim, which manifests itself as a way of the victim of a criminal offense to assert their legal rights and interests, but also is carried out in accordance with the procedural mechanism of implementation laid down in sectoral legislation.

         Regarding the stages of criminal procedural activity of the victim during criminal proceedings, it indicates the initial, main and final. With regard to the communicative prerequisites for the emergence and implementation of criminal proceedings of the victim in criminal proceedings, there are communicative prerequisites such that depend on the will of the victim and those that do not depend on the will of the victim.

         It is argued that the right to procedural communication may be exercised by the victim through the manifestation of criminal procedural activity in the process, and criminal procedural activity, in turn, acts as a catalyst for the beginning, change or termination of criminal procedural relations.

It is noted that the category of criminal procedural activity of the victim during criminal proceedings includes, as an element of the procedural rules ensured, the victim's ability to obtain appropriate procedural status, to obtain information about criminal proceedings, to exchange information on the status (movement) of criminal proceedings, to influence the criminal procedure of criminal proceedings by exercising its legal right to process communication.
