Legal forms of implementation of environmental activities in Ukraine: general theoretical characteristics

Abstract

The article investigates and characterizes the social and legal nature of legal forms of implementation of nature conservation activities in Ukraine. The author examines and defines various doctrinal approaches to the legal forms of implementation of environmental activities, as well as explores the legal nature of this phenomenon in the context of social activity.

The researcher has defined that in relation to the concept of "environmental activity", social activity is a general term, broader in content, which combines all possible activities of people that can be observed in the social environment. It is these varieties of implementation of people's social actions that form the structural characteristic of social activity.

The author defines the author's definition of legal forms of implementation of environmental protection activities as appropriate procedures, which are enshrined in current normative legal acts, which are carried out by specially authorized subjects on a professional basis and are aimed at environmental protection, rational use of natural resources, ensuring environmental safety.

In the course of the research the features that are characteristic of the legal forms of implementation of nature conservation activities are distinguished: 1) secrecy in the legal norm; 2) it is mandatory in nature; 3) creates conditions for the realization of subjective law; 4) it is formed in the form of rights and obligations of participants of legal relations; 5) is carried out in procedural and procedural order; 6) focus on environmental protection; 7) is ensured by all measures of state influence (including legal coercion).

The basic legal forms of realization of nature protection activity are described, namely: 1) legal protection of lands; 2) legal protection of waters; 3) legal protection of forests; 4) legal protection of wildlife; 5) legal protection of atmospheric air; 6) legal protection of subsoil; 7) legal protection of objects and territories of the Natural Reserve Fund of Ukraine. At the same time, the implementation of legal forms of implementation of environmental activities should be integrated, in close relationship.
