Administrative and legal status of Ukrainian citizens-labor migrants in EU countries

Abstract

It was established that the administrative and legal status of citizens of Ukraine – migrant workers in general, and, in particular,
the activities of authorized public administration bodies to ensure the implementation and protection of rights and freedoms of citizens
of Ukraine – migrant workers were not the subject of comprehensive research. It is proved that the administrative and legal status of
citizens of Ukraine – migrant workers is determined by the legislation of Ukraine; the legislation of their host country – the EU country;
norms of international agreements of Ukraine, the binding nature of which was approved by the Verkhovna Rada of Ukraine. The own
vision of the concept “administrative and legal status of citizens of Ukraine – labor migrants” is offered.
It is argued that the administrative and legal status of citizens of Ukraine – migrant workers is characterized by such basic features
as: 1) it is the status of a citizen of Ukraine who carried out, carries out or will carry out paid activities in the EU, not prohibited by law;
2) it is a status that provides for endowment of citizens of Ukraine – migrant workers with certain rights and responsibilities, the
implementation of which is ensured by certain guarantees; 3) the granting of rights and obligations under the status is determined by
the Constitution of Ukraine, the Law of Ukraine “On External Labor Migration”, other legislation governing relations in the field of
external labor migration, the legislation of the host EU country, as well as international treaties of Ukraine, consent to the binding nature
of which was given by the Verkhovna Rada of Ukraine; 4) it is a status that is implemented in relations with public administration bo -
dies: executive bodies of Ukraine that ensure the formation and implementation of state policy in the field of external labor migration (Cabinet of Ministers of Ukraine, central executive bodies, and, in particular, the Ministry of Economic Development); trade and agriculture
of Ukraine, which ensures the formation and implementation of state policy in the field of labor, employment and labor migration;
local state administrations); diplomatic and consular missions of Ukraine in the EU countries; local governments of Ukraine; public
administration bodies of the host country-EU.

Emphasis is placed on possible areas of improvement of domestic legislation and practice of its application in the research area.
