Concept and content of legal compromise in criminal procedure: conceptual approaches

Abstract

This article is devoted to the study of the concept and the content of legal compromise in criminal procedure. There are analysed
conceptual approaches to understanding the essence and the content of legal compromise both in legal science in general and in the
doctrine of criminal procedure in particular. It is stated that the problem of the essence and the content of legal compromise in the cri -
minal procedure has not been almost studied by the domestic doctrine of the science of criminal procedure.
In the course of research, it is made a conclusion that a criminal procedure compromise should be understood as a separate type
of legal compromise, which essence consists in a certain expression of will or desire of the parties to resolve the criminal law conflict
under certain equal conditions, concessions and mutual benefits of the parties.
Conclusions were drawn regarding the nature of the criminal procedural compromise: 1) criminal procedural compromise is one
of the legally established mechanisms for resolving a conflict in criminal proceedings between the parties to the defense and the pro -
secution; 2) institutionalization of incentive criminal procedural and compromise provisions, as well as the formation of the unified system
thereof, reflects the tendency of the modern criminal procedure to differentiate the forms of criminal proceedings with respect to
settling compromise procedures therein and reducing the pressure of criminal repressions; 3) compromise is one of the methods of rea -
lization of the general tasks of the criminal procedural policy, as following: ensuring the priority of human and civil rights and fundamental
freedoms; strict observance of law and order in criminal procedural activity; humanization of criminal procedural legislation;
increasing the level of democratic development of criminal proceedings; social justice of criminal proceedings; establishment of an
effective and independent judiciary; compliance with European and world standards; 4) compromise is expressed in mutual concessions
of the parties to criminal proceedings. The parties to the conflict voluntarily agree to such a compromise in order to achieve their goals,
refusing the earlier accusations and claims. In this case, the parties make some forced concessions, there are costs, a number of possible
negative consequences (a so-called agreement, the terms of which suit everyone); 5) realization of a criminal procedural compromise
is possible in case of fully complies of such legal institution with the principles of criminal procedural law, and the positive consequences
extend to parties thereof; 6) applying a compromise might not be always possible, but selectively (alternatively) if other me -
thods to resolve conflict (procedural tools or procedures) are impossible. That is applying a compromise in criminal proceedings is a
compulsory measure.
