Types of mediation as a form of resolving land disputes

Abstract

The article examines the stages of formation of legislative support for resolving land disputes in the form of mediation and possible
types of mediation as a form of resolving land disputes. 

We consider it expedient to distinguish two stages of formation of legislative support for resolving land disputes in the form of
mediation. At the first stage, mediation with the participation of judges is introduced in the current procedural codes. At the second
stage, work began on the emergence of special legislative regulation of mediation. Bills on mediation are being submitted directly to
the Verkhovna Rada of Ukraine.
According to the results of the study, such types of mediation as forms of resolving land disputes can be proposed.
Depending on the presence or absence of conflict:
a) conflict-free mediation. This type of mediation involves taking action to prevent conflict, for example at the stage of preparing
a land lease agreement or establishing a land easement;
b) conflict mediation. This type of mediation involves the existence of a conflict, when due to different interests or limited land
resources between the parties there is a land dispute.
Depending on whether a lawsuit has been filed in court:
a) pre-trial mediation. It is applied before the beginning of judicial process;
b) during the process. Occurs simultaneously with the trial.
Depending on who is initiating the mediation:
a) private mediation – independent of court proceedings and applied without a trial, the initiative to mediate land disputes is
expressed by the parties to the conflict;
b) with the participation of a judge – an innovation in the current procedural codes, takes place with the participation of a judge
and is an element of the judicial process;
c) on the initiative of the court – mediation takes place on the initiative of the court but then takes place without any participation
of the court.
We believe that in the case of mediation of land disputes, mediation of land disputes in the field of private (property) relations
will prevail over public (managerial or service) relations. Private relations are conditioned by private interests, which can be quite fle -
xib le, while public (managerial and service) relations are conditioned by public interests, which are characterized by mandatory legal
regulation on the basis allowed only what is provided by law, and therefore they are less flexible. Thus, depending on the range of public
interests, it is advisable to distinguish the following types of mediation as a form of resolving land disputes:
a) mediation of land disputes in the field of private relations,
b) mediation of land disputes in the field of public relations.
Depending on the range of land relations that are the subject of the dispute:
a) mediation in the field of servitude relations,
b) mediation in the field of lease relations,
c) mediation in the field of good neighborly relations,
d) mediation in the field of privatization of land relations,
e) etc.
The list of these types of land dispute mediation should not be exhaustive, because it is difficult to predict the scope of all social
relations where the conflict can be resolved through mediation.
We consider it necessary to envisage proposed types of mediation as a form of resolving land disputes in the legislation on mediation,
which is currently in its infancy.
