Some issues of legal regulation of state funds in Ukraine as the basis of financial activity of the state in the modern period
The article is devoted to current issues of legal regulation of state funds in Ukraine as the basis of financial activity of the state
in the modern period, which are marked by the dynamic development of public relations and acute crisis phenomena. Features of deve -
lopment of financial activity of the state, its maintenance and value are characterized. The analysis of the order of creation and use of
the special fund of the budget and target state funds is carried out.
Emphasis is placed on the growing role of financial activities of the state in the modern period, its importance and significance
as a regulator of social, economic and political processes in society and the state.
The content of the financial activities of the state is the formation, distribution and use of centralized and decentralized funds of
the state, designed to ensure the implementation of tasks and functions of the state. By enshrining the social rights of citizens at the cons -
titutional level, the state undertakes to provide and support the relevant categories of the population in need of social assistance, establishes
appropriate payments to citizens and, thus redistributes material benefits in their financial terms. The volume of financial activity
of the state at the present stage of its development, the impact on social, economic, political processes in society and the state is constantly
increasing, so it has largely outgrown its purely ancillary importance only as a means of ensuring the functioning of the state mechanism.
Objectively formed on the basis of commodity-money relations, the financial activities of the state had the same great potential
for regulatory influence on the development of the state and society, as the commodity-money relations themselves.
Equally important is the financial activity of local governments, especially in the implementation of decentralization of power in
Ukraine and increasing the role of local government in general. Moreover, the severity and intensity of financial problems, the approach
to their solution determines the attitude of the state and society to local governments.
Attention is also drawn to the fact that the improvement of legal regulation of relations in the financial sphere is carried out in
Ukraine together with the active search for additional sources to fill the state and local budgets, and the creation of other state trust funds.
It is noted that not all ideas and proposals for the creation of state trust funds, as well as draft laws based on such proposals and
ideas are in line with current legislation of Ukraine and contain constructive provisions on changes that need to be made to the legislation
to implementation these proposals.
The relevant conclusions and proposals of the author on improving the legal regulation of state funds in Ukraine are substantiated.
