Formation and development of scientific concepts in the field of criminal law at the University of Lviv during the Austrian period (1784-1867) and their impact on the current legal doctrine of Ukraine

Abstract

The article deals with the formation and development of scientific approaches in the field of criminal law and process at the Faculty of Law of Lviv University. The achievements of well-known academic professors who have laid the foundations in the field of criminal law and process in Austria for future generations are highlighted. Their contribution to the development of the criminal law and process and the formation of the Law Faculty of Lviv University for the education of employees in government institutions of various types is shown.

In the article, the author tries to draw parallels through the prism of how society developed during the Austrian period and is developing in Ukraine today. There are shown the modern processes in the direction of European integration that are taking place in Ukraine, involving finding ways to establish the values of democracy and the rule of law in society. In this respect, legal education and science in Ukraine play an important role. Where the recognition of legal values is to carry out studies on state-legal issues and to prepare highly skilled personnel for law enforcement agencies, state apparatus and teaching staff.

In Eastern Europe, one of the most famous and ancient Ukrainian universities is the University of Lviv. The stages of development and formation of modern Ukrainian legal science and education are related to the emergence of law faculties. Therefore, the formation of the Faculty of Law of Lviv University is directly related to the European university tradition. Where the development of legal science and education has become part of the intellectual and material progress of Europe, the formation of its legal culture.

The process of formation and development of criminal law science at the University of Lviv dates back to 1784, when the Faculty of Law was identified as a separate structural unit of the University. Criminal law is taught at the department of natural law, the rights of peoples and institutions from 1784 to 1799 years. The department was then headed by Austrian professor Anthony Pfleger. The criminal law was then read by a professor who was sent from Vienna to the Faculty of Law of Lviv University and was his first dean, and later a rector in 1785-1786 and 1801-1802. - Balthasar Borzaga.

One of the most prominent researchers in criminal law at Lviv University in the first half of the nineteenth century was Maximilian Alois Füger von Rehtborn. What he mentioned in his work was – "Does a person accused of committing a criminal offense on the Crown lands of the Austrian Empire, the right to his own protector" drew the public's attention to the protection of human rights and fundamental freedoms. Later, some international bodies, such as the Council of Europe, adopted the Convention "On the Protection of Human Rights and Fundamental Freedoms" dated November 4, 1950, Ukraine ratified the Convention on July 17, 1997.
