Legislative regulation of the settlement of land disputes in the order of mediation

Abstract

The article examines the existing legislation and defines the current state of regulation of public relations for the resolution of land disputes in the order of mediation.

Depending on the range of disputes subject to legislative regulation, there are general and special legal acts. Common regulatory acts regulate the decisions of a wide range of disputes, including land disputes. Special legal acts regulate the resolution of land disputes only.

It is worth noting that the procedural codes of Ukraine do not have any provisions on the possibility of resolving a dispute by means of extrajudicial mediation - an out-of-court settlement of a dispute involving a mediator.

We believe that such an opportunity should be announced in a preparatory meeting and be provided for in the abovementioned procedural codes and be enshrined in articles on holding a preparatory meeting.

In order to increase the ways of securing the rights to land, we consider it necessary to provide in Chapter 25 “Settlement of land disputes” of the Land Code of Ukraine the opportunity to extend cases of extrajudicial settlement of land disputes through mediation.

Based on the analysis of the case law, it can be concluded that the mediation procedure for resolving land disputes is becoming more and more urgent and appropriate. In particular, many court cases on good neighborly relations would be appropriate in mediation. In the case of a court settlement of such land disputes, money, time and, most importantly, land rights are lost after all disputes are not protected.

Therefore, it is possible to speak about the prospect of gradual emergence in the land law of Ukraine of the sub-institute of settlement of land disputes in the order of mediation, which under the conditions of active law enforcement practice and law-making activity regarding the adoption of the Law of Ukraine "About mediation" and introduction of additions to the relevant procedural codes of Ukraine reliable means of guaranteeing the rights to land along with the court and extrajudicial settlement of land disputes already existing in the Land Code of Ukraine.
The sub-institute of land disputes in mediation procedure should be part of the land disputes institute, which will provide a comprehensive and complete legal regulation of all cases of land disputes and will contribute to the fullest guarantee of land rights in case of their violation.
