Competence of local authorities in the organization and implementation of free legal assistance
The article explores theoretical and regulatory approaches to determining the competence of local authorities in organizing and implementing free legal assistance. The political and legal foundations of the formation of competence and independent competence of local authorities in the post-Soviet post-totalitarian country are established. The factors activating the formation of the competence of local governments in organizing and implementing free legal assistance in the context of decentralization and the formation of a national model of local government in the state are considered. The subjects of the formation of the competence of local authorities in the specialized field, as well as the "three-tier" legal basis of such competence are determined.
It is established that the competence of local self-government bodies, as an independent phenomenon, arises only after the constitutional and legal regulation of the institute of local self-government. In structural aspect and in basic properties, it is derived from the competence of state bodies, but also has its own peculiarities, due to the local nature of local self-government bodies, teleological dominant of their activity, protection of human rights within the territorial community.
It is noted that the consideration of the competence of the local self-government of Ukraine in the field of providing free primary legal aid should be carried out on the basis of a systematic analysis of the current legislation. The result of such work is a methodological conclusion about the “three-tier” legal basis of such a profile competence. The first "tier" is the Constitution of Ukraine, whose provisions on the competence of local state administrations and local self-government bodies initiate not only actual duplication but also "diffusion" of power at the level of local self-government and local government in the administrative-territorial units of Ukraine, when the competence of local executive bodies not only "penetrates" into the sphere of functioning of municipal power, but the competence of local self-government - into the sphere of executive power, but also in some cases their competence sons are starting to be overtly competitive, conflicting, contradictory and antagonistic. This state of affairs also exists in the field of providing specialized legal assistance, although at the level of the Constitution of the State it is not mentioned as a direct object of competence regulation by the mentioned public authorities. However, the Constitution contains a number of articles where such activity is directly or indirectly represented, legalized, regulated and regulated. The second “tier” consists of international legal acts in this area, signed by Ukraine and to which Ukraine acceded and ratified. The third "tier" consists of the profile laws of Ukraine, which in content and role in the system of legislation can be conditionally divided into statutory and branch.
The legal basis for the competence of local self-government bodies in the field of providing free primary legal aid is the normative-legal acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, ministries and departments of Ukraine, local state administrations and local self-government bodies on profile issues.
Formation of profile competence of local self-government bodies is in line with the improvement of human rights mechanisms of human and citizen rights and freedoms within local self-government.
