Essence and role of judicial constitutional control: basic approaches to understanding

Abstract

The article is devoted to the study of the nature and role of judicial constitutional control in the modern state. Particular attention was paid to the role of bodies of constitutional jurisdiction to guarantee the rule of law and human rights.

It is concluded that for the exercise of constitutional jurisdiction it is important to exchange ideas between national constitutional courts regarding the understanding of the constitution and human rights.

As László Sólyom noted in Vilnius at a conference dedicated to the 10th anniversary of the Constitutional Court of the Republic of Lithuania (4-5 September 2003), the following are the conditions for the mutual interdependence of constitutional jurisdictions: the former constitutional courts, in a shorter period of time, although the material to be mastered has grown rapidly. In his opinion, it would take ten years for the third generation of the Constitutional Court to reach the level and develop the wealth of jurisprudence, which required the first generation forty years of hard work; 2) the traditional areas of influence of French or German law may be defined more in the structure and powers of the constitutional courts than in their jurisdictions, and more in the general legal culture than in the constitutional decisions. Strong, traditional, German influence is evident in Poland, Hungary, the Czech Republic and Slovenia; 3) according to Laszlo Cholom, the third generation of constitutional courts was born in a favorable international environment when the courts had prosperous international human rights jurisdiction around them. The new courts have already found a common European constitutional language, which they not only learned to pronounce, but were able to express new ideas in that language. At the same time, obtaining international standards is much more than adaptation, it was a mutual process.
